These terms and conditions ("Agreement") govern your use of the on-demand services provided by Sorted Fintech ("Company"), accessible through our website or mobile application ("Platform"). By accessing or using our Platform, you agree to be bound by these terms and conditions. If you do not agree with any part of these terms, you may
not use our services.
1.0 Service Description
a. Sorted Fintech offers an on-demand service platform that connects users with service providers for various services.
b. The services provided by service providers may include pharmacy services, online doctors, plumbers, towing services, mechanic only to mention a few.
c. Company does not directly provide the services but acts as an intermediary between users and service providers.
2.0 User Eligibility
a. To use our services, you must be at least 18 years old and have the legal capacity to enter into a binding agreement.
b. You must also ensure that your use of our services complies with any applicable laws and regulations in your jurisdiction.
3.0Account Registration
a. To access our services, you must create an account on our Platform.
b. You agree to provide accurate and up-to-date information during the registration process.
c. You are responsible for maintaining the confidentiality of your account credentials and are liable for any activities conducted through your account.
4.0 Service Request and Acceptance
a. Users can request services through the Platform by providing relevant details.
b. Service providers have the discretion to accept or decline service requests based on availability, suitability, or any other reasonable criteria.
c. Once a service request is accepted, users will be notified, and they are expected to be available at the designated time and location for the service.
5.0 Pricing and Payment
a. The prices for services will be displayed on the Platform.
b. Users agree to pay the agreed-upon price for the services received.
c. Payment methods accepted by the Platform will be specified.
d. Users are responsible for any additional fees, taxes, or charges associated with the services.
6.0 Service Quality and Liability
a. Company aims to provide a high-quality service but does not guarantee the quality, accuracy, or suitability of the services provided by service providers.
b. Company is not liable for any damages, losses, or injuries incurred during the provision of services by service providers.
c. Users are encouraged to provide feedback and report any issues with the service quality to the Company for appropriate action for example service provider account deactivation.
7.0 User Responsibilities
a. Users agree to provide accurate and truthful information when using the Platform.
b. Users are expected to treat service providers with respect and comply with their instructions and guidelines.
c. Users must comply with all applicable laws, rules, and regulations during the use of our services.
8.0 Returns
As such all orders and services purchases through the Sorted VAS™ cannot be returned except for Service Provider flaws.
9.0 Cancellation
Sorted Fintech reserves the exclusive right to refuse or cancel any transaction/order for products that are listed at an incorrect price or are not available. This is enforceable irrespective of order confirmation or payment confirmation. In such events if the payment has been processed by Sorted Fintech the amount will be refunded via the same mode and currency of original payment and user will be notified of the same with a reasonable mode of communication. After placing an order Sorted will not entertain any user request for order cancellations.
On Services, Sorted Fintech will Charge a 20% cancellation fee.
10.0 Delivery
The title and the risk of the orders shall pass onto you upon our Sorted Delivery (via our delivery partners) delivering the orders to you and you accepting the orders. Every care shall be taken to deliver the orders to the intended recipient. But Sorted Fintech shall not be held responsible for any wrong delivery of the order based on the address given by the User or if any person imposes to be the actual recipient and takes delivery of orders. Sorted Fintech will only process the order after the payment has been processed in case of ‘Online Payment’ or Sorted Fintech Wallet. Sorted Fintech will try to deliver the order (via our delivery partners) as per the order submitted by the user, but it fully reserves a right to deliver a similar or alternate order for reasons beyond its control and any such action shall not be deemed as bad delivery. The user does not have the right to refuse the order at the time of receipt of the ordered items and shall duly make the payment in case of ‘Cash on Delivery’ or ‘Card on Delivery’ payments options.
11.0 Intellectual Property
a. All intellectual property rights related to the Platform, including but not limited to trademarks, logos, and content, are owned by Company or its licensors.
b. Users agree not to use, reproduce, or distribute any copyrighted material from the Platform without obtaining proper authorization.
11.0 Privacy and Data Protection
a. Company collects, stores, and uses user data in accordance with its Privacy Policy, which can be found on the Platform.
b. By using our services, you consent to the collection, storage, and use of your personal data as outlined in the Privacy Policy.
12.0 Termination and Suspension
a. Company reserves the right to terminate or suspend your access to the Platform at any time, with or without cause.
b. Users may also terminate their account by following the procedures outlined on the Platform.
13.0 Dispute Resolution
a. Any disputes arising out of or relating to these terms and conditions shall be resolved through negotiation and mutual agreement.
b. If a resolution cannot be reached, the parties agree to submit the dispute to binding arbitration in accordance with the rules of [arbitration organization].
